For 10 years I have been helping U.S. businesses challenge Canadian sales tax assessments.
The assessments have typically been triggered by ordinary business practices which are permitted under U.S. laws. These assessments could have been avoided with proper guidance. [Common Assessments against US Businesses]
Prevention based approach
I will continue to challenge Canadian tax assessments levied against U.S. businesses. [Dispute Resolution Services]
However, my primary focus is on the early detection and prevention of the issues which lead to those assessments.
To pro-actively identify areas of exposure for U.S. businesses I have developed a comprehensive sales tax questionnaire. Once detection has occurred implementation of the solution is simple. [Do I need cross border advice?] The questionnaire has also been designed to identify sales tax opportunities.
New Canadian Rules
Substantial changes are being made to the Canadian tax rules which apply to non-residents:
- New legislative provisions aimed directly at non-residents are about to be introduced into law
- Canadian tax authorities are revising their administrative policies with respect to fundamental cross border issues
- This new regime will impact on every U.S. corporation which does business with Canadians in relation to goods, services or intangibles
As a result this is a particularly important time for U.S. businesses to ensure that their practises are in compliance.
